Have You Checked Your Required Postings Lately?

As an employer, you're required by federal and state law to have certain notices posted in an area of each of your facilities that has high visibility for employees. If you haven't reviewed your required postings yet this year, you may not be current. All posters listed below can be obtained through the Illinois Department of Labor Web site at http://www.state.il.us/agency/idol/.

State of Illinois Required Postings

  • Notice to Employers and Employees. This poster includes the information needed for payment of wages, Child Labor Law, Minimum Wage Law, and the One Day Rest in Seven Act. It's required for all Illinois employers.
  • Equal Pay Act of 2003. The Equal Pay Act of 2003 prohibits employers with four or more employees from paying unequal wages to men and women for doing the same or substantially similar work requiring equal skill, effort, and responsibility under similar working conditions for the same employer in the same county-except if the wage difference is based on factors other than gender.
  • Victims' Economic Security and Safety Act. The Victims' Economic Security and Safety Act (VESSA) provides that employers may not discharge or discriminate against an employee who's a victim of domestic violence or who has a family or household member who's a victim of domestic violence, for taking up to a total of 12 work weeks of leave during any 12-month period to address the domestic violence.
  • Right-to-Know (Toxic Substances Disclosure). This poster explains employee rights and employer responsibilities under the Illinois "Right To Know Act." It's required of public sector employees only.
  • Workers Compensation Notice. All employers must post this notice, briefly explaining employees' rights and responsibilities if there's a work-related injury. It also has a place to list the employer's insurance carrier or the person who administers workers' compensation claims.
  • Unemployment Insurance Benefits. This poster explains how to file a claim, benefit amounts, and taxation on benefits. It's required of all Illinois employers.
  • Emergency Care for Choking. The poster explains emergency care for conscious and unconscious choking victims and has a place to list an emergency phone number. It must be posted in every food service facility.

Federal Posters

  • Equal Employment. This poster cautions against discrimination based on age, race, color, sex, religion, disabilities, and national origin. All employers with 15 or more employees must display it, and it's available in Spanish.
  • Minimum Wage, Overtime, Child Labor. The poster is for of all employers covered under the Fair Labor Standards Act.
  • Employee Polygraph Protection Act. This poster explains the prohibitions, exemptions, examinee's rights, and enforcement for the law.
  • Family Medical Leave Act. Employers must post this, which gives leave for certain family and medical reasons.
  • Federal Government Contracts. Contractors and sub-contractors with contracts that exceed $10,000 under the Walsh-Healey Public Contracts Act or contracts in excess of $2,500 under the Service Contract Act must post this poster.
  • Federally Financed Construction. This poster must be posted at the job site if the company is engaged in work covered by the Davis-Bacon Act or one of the federal laws applicable to federal or federally assisted construction.
  • Occupational Health & Safety Act. The OSHA poster explains the requirements of the act and is required of all employers covered by the federal OSHA law. IBI
